Fair point,well made BD. The point immersed in all that is that councils have to follow the rules like everyone else but they have also to be very careful which legislative device they use to impose the rules. By-laws in this case are not a suitable vehicle.

Confused? Then I would suggest that the Government and various councils have achieved their aim-make it completely unintelligable and no-one will challenge it.

Yes it can be challenged by Judicial Review which is costly and risky- I did post a reply yonks ago quoting advice from a senior Solicitor of my employer- Large London Local Authority- basically an individual could challenge a Local bye-law via JR or wait to be prosecuted for breach of a bye law then launch anappeal in an appellate court on similar grounds as a JR application.

Very risky - potentially very costly- I wouldnt be prepared to risk my home for it- but the diehard revolutionaries and anarchists amongst us might be.

Perhaps we should be encouraging angling in the judiciary then?.......you know, free peir tickets, trip out on the boat, discount for ragworm...that sort of thing.....
